Starboard continues fraudulent marketing

The Starboard ad pretends that the JL board depicted is a Starboard product.
This month's issue of Stand Up Paddle Magazine features an inside cover, two-page spread ad by Starboard. And once again, they are using a Jimmy Lewis board in their ad with Starboard stickers on it. Starboard isn't a small company. They've got their stable of riders, in-house shapers, and a full marketing department. So WHY do they need to use my board in their advertisements, PRETENDING that it's a Starboard?

This isn't the first time it has happened. Starboard's 2011 SUP Catalog featured Connor Baxter riding a Jimmy Lewis custom which had been photo-shopped to carry the Starboard markings. In June 2011, a Starboard ad came out in Stand Up Journal with a different shot of Connor on the same board. My attorney issued a demand that Starboard discontinue the deceptive practice. Svein Rasmussen, President of Starboard acknowledged that he knew the board was a Jimmy Lewis board and not a Starboard SUP being used in the catalog and ad. He defended that Starboard was within their rights to use and alter the photo. After further legal pressure, however, he issued an apology to me, a promise to never engage in this practice again, and a letter to all Starboard dealers to make them aware of the misleading photos.

YET, here we are 6 months later, and Starboard is doing it again. The new ad features Starboard's top wave rider, Connor Baxter, again on a Jimmy Lewis board, turning hard and fast on a wave. The caption claims that Starboard construction delivers, "faster acceleration, more responsive turning, and lower swing weight." So WHY do they need their rider on a Jimmy Lewis board to depict that claim in action? More interestingly, why do some of their riders prefer to ride other brands when on crucial waves or in major races? Connor Baxter, Starboard's top rider has the right to ride Jimmy Lewis boards in big waves and win all three races of the Hawaii Triple Crown series on boards by S.I.C (Sandwich Island Creations: Connor in fact won all three races of that series using his SIC board and Starboard claimed 3 Starboard victories). But Starboard does NOT have the right to deceive the public into thinking these achievements were made on their products.
Why does it really matter?

THIS PRACTICE IS ILLEGAL. The U.S. Lanham Act prohibits companies from passing off another's product or work as their own. The consumer is being deceived into believing that Starboard products are being shown when they are not.

About 6-8 months before the first Starboard ad came out which featured my board photo shopped with the Pro Wave graphics on it, I had adopted the policy of not making any custom boards for any riders who represented other companies, specifically for the reason that this problem is happening. And sure enough it happened. I am in the process of consulting my attorney to weigh my options, including the possibility of obtaining an injunction against Starboard and its US wholesaler Trident Performance Sports since their promise to refrain from engaging in the same allegedly unlawful conduct has proven to be unreliable.

PSSSHHH, bueno, lo hacen asi casi todas las marcas y casi todos los riders (he dicho casi), no es nada nuevo, habría que decirle a JL que no nos impresiona este asunto.......una rabieta para hacer ver que hace tablas muy buenas para pros, que no es lo mismo que hacer buenas tablas de producción....

Esto tampoco es una tabla suya y es un vídeo colgado en su propia web

! starboard es de las marcas en las que más riders no usan sus tablas sino otras decoradas por starboard.....pero hay que reconocer que son tablas muy accesibles para gente de la calle (y eso que a mi personalmente no me gustan un carajo) pero reconozco que su política de modelos es cojonuda, es normal que no saquen a producción las tablas que usan sus riders, sería una locura....

Pero sigue siendo penoso que modifiquen una foto para que parezca que la tabla es de su produccion. Tanto les cuesta que el pro de turno se haga una sesion de fotos con tablas salidas de su fabrica? o debemos suponer que sus tablas no aguantarian la sesion de fotos? o que al pro de turno le gustan tan poco que no quiere ni usarlas 5 minutos? que luego las usen en competiciones, vale, perfecto, con bien de $$$ y un contrato el shaper custom de turno les hace la tabla, se la pinta con sus logos y se calla con obligacion contractual.
 
No modifican la foto, en la foto sale con una tabla JL con decoración ST, pero en el texto de la foto hacen publicidad de las tablas ST sin mencionar que esa tabla de la foto es una JL, lo que demanda el tío es que deberían decir que la tabla es una JL...

Las fotos de la publicidad son solo las 2 de arriba las otras son las que muestran los de JL para demostrar que la tabla es suya.

A mi me parece una Pataleta y querer sacar marketing oportunista más por parte de JL que de Starboard, que más da que foto sea la de la publi, si ni se distinque que tabla es en el agua en la foto, es un recurso gráfico para publicidad. Otra cosa es que sacaran una foto de la tabla donde se viera perfectamente y dijeran que esa es la tabla Starboard, entonces si sería un engaño, pero lo otro.....pssss, creo que todos en este mundillo ya sabemos ya como va el tema de las tablas de los pros camufladas.....

Ahi queda un vídeo con la tabla comentada en acción, la verdad que se ve que va bastante mejor que la de serie que tiene bajo los pies Zane que va toda descontrolada....
